Welcome to Rose & Rae Fine Custom Jewelry. These Terms and Conditions (“Terms”) govern your access to and use of roseandraejewelry.com, including purchases, custom-design services, consultations, and communications with Rose & Rae.
Throughout these Terms, “Rose & Rae,” “we,” “us,” and “our” refer to [INSERT REGISTERED FLORIDA BUSINESS NAME].
By visiting our website, submitting a consultation request, approving a custom design, or purchasing a product, you agree to these Terms, our Privacy Policy, Refund Policy, Shipping Policy, and any additional terms presented with your order.

1. Eligibility
You must be at least 18 years old or have the permission and supervision of a parent or legal guardian to use this website or make a purchase.
By placing an order, you represent that the information you provide is accurate, that you are authorized to use the selected payment method, and that your purchase is for a lawful purpose.
2. Our Products and Services
Rose & Rae offers fine jewelry, lab-grown diamonds, engagement rings, custom-designed pieces, redesigned jewelry, and related services.
Product availability, designs, diamonds, gemstones, metals, settings, prices, and services may change without notice.
We reserve the right to limit quantities, discontinue products, refuse service, or decline an order when reasonably necessary.
3. Lab-Grown Diamonds
Lab-grown diamonds are real diamonds with the same crystal structure, chemical composition, hardness, and brilliance as mined diamonds. Their distinguishing characteristic is their laboratory origin.
Lab-grown diamonds may be graded by independent laboratories, including the Gemological Institute of America (GIA) and the International Gemological Institute (IGI).
When a grading report is included with a diamond, the report contains the independent laboratory’s assessment of that diamond. Rose & Rae does not control the grading standards, opinions, or determinations of an independent laboratory.
Customers should review the applicable grading report, measurements, diamond characteristics, and purchase details before approving a stone.
4. Product Images and Descriptions
We make reasonable efforts to display our products, diamonds, metals, colors, measurements, and details accurately.
However, photographs, videos, renderings, and digital images may appear differently depending on lighting, magnification, camera settings, and the customer’s screen or device. Images may not represent a product’s exact size or scale.
Because jewelry is handcrafted and diamonds and gemstones have individual characteristics, minor variations may occur. These natural or handcrafted variations do not necessarily constitute a defect.
If a product description or price contains a material error, we may correct the information or cancel the affected order. If payment has already been collected for a canceled order, the applicable amount will be refunded.
5. Custom-Design Process
Every custom piece begins with a consultation. The Rose & Rae custom-design process may include:
- Consultation
- Stone selection
- Design and sketch or rendering
- Customer approval
- Handcrafting
- Final fitting and care guidance
During the consultation, we may discuss the occasion, style, budget, timeline, ring size, diamond, gemstone, metal, setting, and other design preferences.
After a stone is selected, Rose & Rae may create a sketch, rendering, written description, invoice, or other design documentation for review.
6. Customer Approval
Customers are responsible for carefully reviewing all order and design details before approval, including:
- Diamond or gemstone selection
- Grading report
- Metal type and color
- Ring size
- Setting and design
- Engraving or personalization
- Measurements and proportions
- Price
- Shipping information
- Estimated production timeline
Approval may be provided electronically through Shopify, email, invoice payment, written confirmation, electronic signature, or another method agreed upon by Rose & Rae and the customer.
Once a customer approves a design or Rose & Rae begins sourcing materials or production, requested changes may not be possible. Approved changes may result in additional charges and a revised completion date.
7. Custom Designs and Renderings
Sketches and digital renderings are used to communicate the overall design concept. A finished handcrafted piece may contain minor differences resulting from manufacturing, stone setting, polishing, material behavior, or necessary structural adjustments.
Rose & Rae may make reasonable technical adjustments to ensure the piece is secure, wearable, and suitable for production while preserving the approved overall design.
8. Customer-Provided Jewelry, Stones, or Materials
When Rose & Rae agrees to inspect, redesign, repair, remove, or reset a customer-provided diamond, gemstone, jewelry piece, or metal, the customer represents that they are the lawful owner of the property or have permission from its lawful owner.
Previously worn, repaired, treated, damaged, or older materials may contain weaknesses that are not visible before work begins. Rose & Rae will exercise reasonable care but cannot guarantee that customer-provided materials will withstand removal, resetting, repair, cleaning, polishing, heat, pressure, or other work.
Any known damage, treatment, repair, or condition should be disclosed before work begins.
9. Ring Sizing
Customers are responsible for providing the requested ring size.
Professional sizing is the most accurate method. Finger size may change due to temperature, time of day, health, pregnancy, weight changes, and other factors.
Most Rose & Rae settings may be resized approximately one to two sizes after a proposal. However, resizing depends on the design, metal, stone placement, engraving, and amount of adjustment required. Some settings may have limited resizing options or may require remanufacturing.
Any applicable resizing charges, shipping costs, and timelines will be communicated before work begins.
10. Prices, Taxes, and Payment
Unless otherwise stated, prices displayed on the website are in U.S. dollars.
Applicable taxes, shipping fees, insurance, customization charges, and other disclosed costs may be added at checkout or included in a custom invoice.
Payment must be made using a payment method accepted by Shopify or Rose & Rae. By submitting payment information, you represent that you are authorized to use that payment method.
Orders are not guaranteed until payment is authorized and Rose & Rae accepts the order.
Custom orders may require a deposit or full payment before stone sourcing, design work, or production begins. Any deposit and payment terms will be disclosed on the applicable invoice or order confirmation.
11. Order Acceptance and Cancellation
An automated order confirmation acknowledges that we received your order; it does not necessarily mean that the order has been accepted.
Rose & Rae may refuse or cancel an order because of:
- Product or diamond unavailability
- Incorrect product or pricing information
- Payment authorization problems
- Suspected fraud or unauthorized activity
- Shipping restrictions
- Incomplete or inaccurate customer information
- An inability to complete the requested design
If Rose & Rae cancels an order after collecting payment, we will refund the amount owed for the canceled portion of the order.
Customer-requested cancellations are governed by the Refund Policy and any custom-order terms provided before payment or production.
12. Production and Shipping
Ready-to-ship and custom jewelry may have different processing and delivery timelines. Custom-production estimates may depend on design approval, diamond or material availability, manufacturing, stone setting, quality inspection, and shipping.
Any completion or delivery date is an estimate unless Rose & Rae expressly agrees in writing that a date is guaranteed.
If an order cannot be shipped within the promised timeframe, Rose & Rae will provide notice and any options required by applicable law.
Customers are responsible for providing a complete and accurate delivery address. Additional charges resulting from an incorrect address, refused package, failed delivery, or requested redirection may be the customer’s responsibility.
Shipping, insurance, delivery, lost-package, and signature requirements are governed by our Shipping Policy.
13. Returns, Refunds, and Exchanges
Returns, refunds, exchanges, cancellations, and final-sale items are governed by the Refund Policy displayed on our website and any additional terms disclosed before placing a custom order.
Please review the Refund Policy before purchasing. Custom, personalized, engraved, altered, resized, redesigned, or specially sourced items may be subject to different terms from ready-to-ship products when clearly disclosed before purchase.
Nothing in these Terms limits rights that cannot legally be waived.
14. Jewelry Care and Inspections
Diamonds are durable but not indestructible. A sharp, direct impact may chip a diamond, particularly a shape with pointed corners.
To protect your jewelry:
- Keep it away from lotion, perfume, and harsh chemicals.
- Remove it before swimming, showering, exercising, or cleaning.
- Clean it gently with warm water, mild dish soap, and a soft-bristled brush.
- Dry it with a lint-free cloth.
- Store pieces separately in a lined box or pouch.
- Have prongs and settings professionally inspected every 6–12 months.
Normal wear, scratches, impact damage, worn prongs, improper cleaning, chemical exposure, loss, theft, or damage caused by another jeweler are not automatically considered manufacturing defects.
15. Warranties
Any warranty offered with a product or service will be provided separately in writing.
Except for an express written warranty and any warranties that cannot legally be excluded, products and services are provided on an “as available” basis to the fullest extent permitted by law.
Rose & Rae does not make warranties beyond those expressly stated in writing.
16. Website Accounts
If you create an account, you are responsible for maintaining the confidentiality of your login information and for activity conducted through your account.
Notify us promptly if you believe your account has been accessed without authorization. We may suspend or terminate an account when reasonably necessary to protect the customer, Rose & Rae, or other users.
17. Acceptable Website Use
You may not use the website to:
- Violate any law or regulation
- Commit fraud or submit false information
- Infringe another person’s intellectual-property or privacy rights
- Transmit malicious software or harmful code
- Interfere with the website’s security or operation
- Scrape, copy, or collect website content through unauthorized automated means
- Attempt to gain unauthorized access to an account, system, or network
- Impersonate another person or business
- Use Rose & Rae content for unauthorized commercial purposes
We may restrict or terminate access for conduct that violates these Terms.
18. Intellectual Property
The Rose & Rae name, logo, website, photographs, videos, graphics, written content, sketches, renderings, jewelry designs, product descriptions, and other materials are owned by Rose & Rae or used with permission.
These materials are protected by intellectual-property laws and may not be reproduced, modified, distributed, sold, published, or commercially used without prior written permission.
Purchasing a custom piece does not transfer ownership of Rose & Rae’s underlying designs, sketches, renderings, photographs, or other intellectual property unless expressly agreed in writing.
19. Reviews, Photographs, and Customer Content
If you submit a review, testimonial, photograph, design reference, comment, or other content, you represent that you have the right to provide it and that it does not violate another person’s rights.
Submitting private design references for a consultation does not automatically authorize Rose & Rae to use them publicly.
If Rose & Rae would like to feature your photograph, testimonial, or custom piece in marketing, we will request any permission required by applicable law.
20. Third-Party Services and Links
Our website may use or link to services provided by Shopify, payment processors, shipping carriers, Google, Meta, TikTok, social-media platforms, and other third parties.
Rose & Rae does not control third-party websites or their availability, security, content, terms, or privacy practices. Your use of a third-party service may be governed by that provider’s own terms and policies.
21. Email and SMS Communications
You may receive transactional communications regarding consultations, orders, payments, production, shipping, returns, repairs, or customer service.
If you opt in to marketing emails, you may unsubscribe using the link included in the email.
If you expressly opt in to marketing text messages, you may receive recurring automated promotional or personalized messages. Consent is not a condition of purchase. Message frequency may vary, and message and data rates may apply.
Reply STOP to unsubscribe from marketing text messages or HELP for assistance.
22. Privacy
Our collection and use of personal information are governed by our Privacy Policy.
By using the website, you acknowledge that information may be processed by Rose & Rae and its service providers as described in that policy.
23. Disclaimer of Liability
To the fullest extent permitted by law, Rose & Rae will not be liable for indirect, incidental, special, punitive, or consequential damages arising from the website, third-party services, or the use or misuse of a product.
To the fullest extent permitted by law, Rose & Rae’s total liability relating to a product or order will not exceed the amount paid for the product or service giving rise to the claim.

These Terms, together with the Privacy Policy, Refund Policy, Shipping Policy, applicable product information, and any written custom-order agreement, constitute the agreement between you and Rose & Rae concerning your use of the website and applicable purchases.
If a written custom-order agreement conflicts with these general Terms, the custom-order agreement controls for that order.
